JOYRIDE MOBILITY RENTALS

Mobility Equipment Rental Agreement, Assumption of Risk, Release of Liability, and Arbitration Agreement

READ CAREFULLY BEFORE SIGNING

THIS AGREEMENT CONTAINS A RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND ARBITRATION PROVISION. BY SIGNING, YOU ARE WAIVING CERTAIN LEGAL RIGHTS.

This Agreement is entered into between Joyride Mobility Rentals (“Joyride”) and the undersigned renter (“Renter”). Renter agrees to rent and operate mobility equipment, including but not limited to electric convenience vehicles (ECVs), scooters, wheelchairs, batteries, chargers, and accessories (collectively, the “Equipment”), subject to the terms below.

RENTAL TERMS AND RESPONSIBILITIES

Renter agrees to return the Equipment at the agreed date and time. Failure to return within twenty-four (24) hours may result in additional charges and full replacement responsibility.

Renter agrees to immediately notify Joyride of any loss, theft, malfunction, accident, or damage. Joyride reserves the right to inspect Equipment and charge the payment method on file for repair or replacement costs resulting from misuse, negligence, or violation of this Agreement.

OPERATING RULES

Renter agrees to operate the Equipment safely and follow all instructions provided by Joyride. Renter specifically agrees:

  • Only one person may use the Equipment

  • Operator must remain seated while in motion

  • Operate at safe speeds comparable to walking pace

  • Reduce speed when turning or in crowded areas

  • Remain aware of surroundings

  • Do not use on stairs, escalators, or unsafe terrain

  • Do not drive over curbs or obstacles greater than approximately three (3) inches

  • Do not operate in standing water, heavy rain, or severe weather

  • Do not operate under the influence of alcohol or drugs

  • Do not tow objects or carry passengers

  • Do not exceed weight limits

CONDITION AND RESPONSIBILITY FOR EQUIPMENT

Renter acknowledges the Equipment is in good working condition unless otherwise noted and accepts it as safe and suitable. Renter agrees to return it in the same condition, normal wear and tear excepted.

Renter accepts full financial responsibility for any loss, theft, or damage during the rental period.

RELEASE OF LIABILITY AND WAIVER OF CLAIMS

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, RENTER KNOWINGLY AND VOLUNTARILY RELEASES, WAIVES, DISCHARGES, AND AGREES TO HOLD HARMLESS JOYRIDE MOBILITY RENTALS, ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUCCESSORS, ASSIGNS, AND ALL MANUFACTURERS, DISTRIBUTORS, AND SUPPLIERS OF THE EQUIPMENT (COLLECTIVELY, “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, CAUSES OF ACTION, OR LIABILITIES OF ANY KIND ARISING OUT OF OR RELATED TO THE POSSESSION, USE, OR OPERATION OF THE EQUIPMENT.

THIS RELEASE EXPRESSLY INCLUDES, WITHOUT LIMITATION, CLAIMS ARISING FROM THE NEGLIGENCE OF ANY RELEASED PARTY.

 

`ASSUMPTION OF RISK

Renter acknowledges that mobility equipment involves inherent risks, including but not limited to tipping, collisions, terrain hazards, mechanical failure, environmental conditions, and operator error.

RENTER VOLUNTARILY ASSUMES ALL RISKS, KNOWN OR UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF ANY RELEASED PARTY.

 

INDEMNIFICATION

Renter agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, liabilities, costs, and attorneys’ fees arising out of Renter’s use, misuse, or violation of this Agreement.

PAYMENT AUTHORIZATION

Renter authorizes Joyride to charge the payment method on file for any unpaid rental fees, late fees, damage charges, repair costs, replacement costs, cleaning fees, retrieval costs, or other charges incurred under this Agreement.

REPOSSESSION AND TRACKING

Joyride reserves the right to retrieve or repossess Equipment if used in violation of this Agreement or if at risk. Renter agrees Joyride may use GPS or tracking technology to locate Equipment.

OPPORTUNITY TO ASK QUESTIONS

Renter acknowledges that he or she has carefully read this Agreement, understands its contents, and has had the opportunity to ask questions and seek clarification prior to signing.

ARBITRATION AGREEMENT

Any dispute, claim, or controversy arising out of or relating to this Agreement or use of the Equipment shall be resolved through binding arbitration governed by the Federal Arbitration Act.

Arbitration shall be conducted:

  • By a single neutral arbitrator

  • Under the rules of the American Arbitration Association

  • In Seminole County, Florida

  • On an individual basis only (no class or collective actions)

The arbitrator may award any relief permitted by law.

BY CHECKING THE BOX, THE PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY AND AGREE TO RESOLVE DISPUTES THROUGH ARBITRATION.

 

MINOR CHILD WAIVER (FLORIDA LAW COMPLIANT)

If the Equipment is used by a minor, the undersigned adult represents that he or she is the natural guardian of the minor and agrees as follows:

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF JOYRIDE MOBILITY RENTALS USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM JOYRIDE MOBILITY RENTALS IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, OR PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND JOYRIDE MOBILITY RENTALS HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

The undersigned natural guardian:

  • Agrees to the release on behalf of the minor

  • Assumes inherent risks of the activity

  • Agrees to indemnify and hold harmless the Released Parties

 

VENUE

To the extent any matter is not subject to arbitration, exclusive venue shall be in Seminole County, Florida.

SEVERABILITY

If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements.
